The claim “Part of THE LÄND” is one that all companies based or producing in Baden-Württemberg are invited to use in order to establish a clear brand association with the new umbrella brand of the state of Baden-Württemberg (THE LÄND) and to present themselves to the outside world as part of this campaign. Use is free of charge and subject to the following conditions.
The respective company (hereinafter: user) may only use the claim in the specified form, revocably, and only within the framework of statutory provisions. The state of Baden-Württemberg does not provide legal advice and therefore bears no responsibility for the legal admissibility of any advertising measures of the user that uses this claim. The user must therefore ensure that its use of the claim neither infringes the rights of third parties nor otherwise violates applicable law, in particular the provisions of competition law and other special advertising or intellectual property laws. The user must thus independently verify whether it is misleading when its goods or services are advertised with the claim “Part of THE LÄND”. Should third parties assert claims for infringement of their rights against the state of Baden-Württemberg based on unlawful use of the claim by the user, the user shall indemnify the state of Baden-Württemberg against such claims. The claim explicitly does not represent a quality feature or seal of approval that is checked or awarded by the state of Baden-Württemberg. No guarantee is given for the use and existence of the claim “Part of THE LÄND”. The state of Baden-Württemberg reserves the right to change or discontinue the use of the umbrella brand and/or the claim (even temporarily) or to prohibit it at any time, in particular if it is used in a manner that violates the liberal and democratic constitutional order or the legal system or harms the interests of the state of Baden-Württemberg.
The umbrella brand THE LÄND is an EU trademark registered for the state of Baden-Württemberg. The State Ministry recommends that potential users seek legal advice before using the umbrella brand. The free permission to use the umbrella brand within the scope of the claim does not grant any rights to the registration.
